Exclusive Content License & Submission Policy

Professional Pickleball Association (“PPA Tour”)

Welcome to the PPA Tour platform, encompassing our websites, social media pages, and applications (collectively, the “Platform”). This document serves as the Exclusive Content License & Submission Policy (“Agreement”) and outlines the terms between you and us concerning any content you contribute to the Platform. This includes, but is not limited to, photos, videos, and written material (hereafter referred to as “Your Content”).

Exclusive License Grant

By submitting Your Content to the PPA Tour Platform, you grant us an exclusive, perpetual, irrevocable, sublicensable, and transferable right to use, copy, reproduce, publish, distribute, and exploit Your Content in various forms. This may include, but is not limited to, its use in advertising, licensing to third parties, brand promotions, merchandise, and pursuit of infringement claims. Once submitted, you agree not to distribute Your Content elsewhere without our consent.

Your grant includes rights for us to:

• Post Your Content on our Platform.
• Use Your Content in promotional materials.
• License Your Content to third parties for a fee.
• Seek advertising and sponsorship opportunities related to Your Content.
• Claim fees and damages for infringements of Your Content.
• Incorporate Your Content in merchandise (e.g., apparel, equipment).

Subject to this Agreement, you retain any residual rights in Your Content.

We reserve the right to manage, edit, or remove Your Content at our discretion and are not obligated to utilize any submitted content.

Prohibited Content

You must not submit content that:

• Infringes on third-party intellectual property rights.
• Is already sold or exclusively licensed elsewhere.
• Is defamatory, libelous, or slanderous.
• Promotes illegal activities or includes prohibited materials.
• Features individuals without their consent.
• Encourages dangerous activities.
• Is abusive, threatening, or obscene.

Representations and Warranties

You assure that Your Content adheres to these guidelines and that:

• You rightfully own or have permissions for Your Content.
• Your Content does not violate any third-party rights.
• You have obtained necessary consents from all featured parties.

Incorporation of Terms of Use

This Agreement complements our Terms of Use, which are integrated herein. By submitting Your Content, you agree to abide by both documents.
